Lisa R. Lifshitz, Partner and Chair of our Technology and Privacy & Data Management Groups, will be speaking on the “Keeping Track of Employees in a Digital World” panel at the upcoming 2025 ABA Privacy and Emerging Technology National Institute on March 20, 2025 in Washington, DC.
In an era where technology enables unprecedented levels of employee monitoring, finding the right balance between productivity and privacy is increasingly a challenge for businesses. In the past year, scrutiny of online tracking technologies has intensified significantly, making it even more critical for businesses to understand the evolving legal landscape of online tracking practices, particularly when directed towards employees. This panel will:
- Delve into employer use of biometrics (facial recognition, fingerprint scanning, and more), including privacy and security risks associated with widespread adoption of biometric authentication methods
- Discuss workplace (including travel) policy implications of recent healthcare, reproductive, and state privacy laws
- Explore the legal issues and considerations regarding employer use of geofencing technologies, especially in light of recent state privacy laws
- Assess the growing number of state laws and regulations addressing the use of AI in the workplace, including for employee recruiting, hiring, performance review, and promotion
